These Terms of Service apply to the website and pest control services provided by Biopest Control De Plagas SLU, with CIF B72454333, trading as Axar Pest Control. We are based in Torrox Costa, 29793, Malaga, Spain. Any reference to "we", "us" or "our" in these terms means Biopest Control De Plagas SLU trading as Axar Pest Control. By using this website or requesting our services, you agree to these terms.
This website is provided for information about our pest control services and to allow you to contact us for quotes and appointments. You may use the site for lawful purposes only. You must not misuse the site, for example by submitting false or misleading information, attempting to gain unauthorised access, introducing viruses or other malicious code, or scraping content without permission. We reserve the right to restrict access to the site at any time without notice.
Any quote we provide is an estimate based on the information you give us and, where applicable, a brief assessment of the situation. The final price for a treatment is confirmed after an inspection of the property, when the extent of the infestation, access requirements and treatment method can be properly assessed. If the final price differs from the original estimate, we will explain the reasons before proceeding. Quotes are provided in euros and are valid for 30 days from the date given, unless stated otherwise.
Before carrying out a treatment, we normally need to inspect the affected area to identify the pest, locate nests or entry points and assess the extent of the problem. For an inspection to take place, we need safe and reasonable access to the relevant areas of the property. You may be asked to move furniture, stored items or personal belongings to allow access. If access is not possible on the agreed date, we may need to reschedule, and our cancellation terms may apply.
Pest control treatments are carried out using professional products and methods appropriate to the pest identified. Results can vary depending on the severity of the infestation, the property type, environmental conditions and other factors outside our control. While we aim to resolve pest problems effectively, we cannot guarantee a specific outcome or that pests will not return after treatment, particularly where conditions that attract or allow pests to enter the property remain unchanged.
To help us carry out treatments safely and effectively, you agree to:
You are responsible for providing safe access to the areas to be treated. This includes ensuring that our technician can reach the affected areas without risk, that floors and surfaces are safe to walk on, and that any pets or obstacles are removed. If areas to be treated are not safely or reasonably accessible, we may not be able to complete the treatment and additional charges may apply for a return visit.
You agree to follow all safety instructions provided by our technician. This may include keeping children, pets and vulnerable people away from treated areas for a specified period, ventilating rooms after treatment, avoiding contact with treated surfaces until dry, and following any specific guidance for the product used. We are not responsible for issues arising from failure to follow safety instructions that have been clearly communicated.
Some pest problems require more than one treatment to be effective. Where a follow-up visit is recommended, we will explain why it is needed and arrange a convenient time. Follow-up treatments may be included in the original quote or may be charged separately, depending on the service agreed. We will confirm any additional costs before carrying out a follow-up treatment.
If you need to cancel or reschedule an appointment, please contact us as soon as possible. We ask for at least 24 hours' notice where reasonably possible. Cancellations made with less than 24 hours' notice, or missed appointments where access has not been provided, may be subject to a call-out fee to cover the technician's time and travel. Where a treatment has already begun, the full agreed price remains payable. We reserve the right to reschedule or cancel appointments in circumstances outside our control, such as severe weather or access issues, without liability.
Payment for one-off treatments is due on completion of the work unless otherwise agreed in writing. For ongoing contracts, payment is due according to the terms set out in the service agreement. Accepted payment methods include cash and bank transfer, and we may offer additional methods from time to time. If payment is not made when due, we may suspend further services until the outstanding amount is settled.
To the fullest extent permitted by law, we are not liable for:
Our liability for any claim arising from our services is limited to the amount paid by you for the specific treatment that gave rise to the claim. Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence or for any other liability that cannot be excluded by law.
We do not guarantee permanent prevention of pests. Pest control treatments reduce or resolve an existing problem, but pests can return if the conditions that attracted them or allowed them to enter the property are not addressed. We provide prevention advice where appropriate, but ongoing pest prevention depends on factors including property maintenance, hygiene and environmental conditions that are outside our control.
We provide pest control services within approximately 60 km of Torrox Costa, including Nerja, Frigiliana, Torre del Mar, Velez-Malaga, Algarrobo Costa, La Herradura, Almunecar, Rincon de la Victoria and Malaga. Whether we can attend a specific location depends on access, treatment type and availability. We reserve the right to decline or limit service to a particular area at our discretion.
